Topic: Things we have learned about Capacity from the Sterling and Redstone (and other) Cases.
This presentation will provide an overview of both the Sterling case (his firm represents Shelly Sterling) and the Redstone case (his firm represents Manuela Herzer, the long-time friend) and other recent cases in which capacity and health care directives have been at issue. Marc will also address a few related issues for preparers of estate planning documents.
ABOUT OUR SPEAKER
Marc M. Stern is a partner in the Los Angeles-based law firm of Greenberg Glusker Fields Claman & Machtinger LLP. Mr. Stern’s legal practice is concentrated in the areas of estate planning, probate and trust administration, with an emphasis on tax matters, trust and tax litigation and prenuptial agreements; he has also served as an expert witness. A 1986 graduate of the USC Gould School of Law, Mr. Stern has been a lecturer for California’s Continuing Education of the Bar, an author for many of its written publications in the area of estate planning, and an editor of and contributing author to its Fourth Edition of Drafting California Revocable Living Trusts and Third Edition of Drafting California Irrevocable Living Trusts. For more than 20 years, Mr. Stern has taught a course in income taxation of estates, trusts and beneficiaries at the Los Angeles campus of the Golden Gate University School of Accounting and Taxation and for five years taught a similar class for the Loyola Law School Tax LLM program. Mr. Stern has previously presented seminars regarding the preparation of the Federal estate tax return (Form 706) for the California CPA Foundation, taught the Gifts, Wills and Trusts course at the USC Gould School of Law as an adjunct Professor and presented papers and lectured on a wide variety of subjects for numerous institutions and at many fora from San Diego to Seattle and from Hawaii to Pennsylvania. Other bar activities have included serving on the Executive Committee of the Los Angeles Bar Association’s Trusts and Estates section, on the Board of the California Young Lawyers Association and as a member of the Continuing Education of the Bar’s Governing Committee. Marc is an avid baseball fan who, as of 2016, will have attended the last 30 All Star games and official regular season games at 52 different ballparks around the world.
